Terms and Conditions for Photography Services

Please read the following terms and conditions carefully. By engaging in a photography service agreement with VisionCapture, you agree to be bound by these terms and conditions:

1. Booking and Payment: 20% non-refundable deposit of the agreed quote price is required at the time of booking to secure your photography session. The remaining balance must be paid in full on or before the day of the session. Payments can be made via bank transfer or Cash.

2. In the event of cancellation by the client, the deposit will not be refunded.

3. I will only photograph on the agreed time frame, If the customer wants to extend the agreed time, they will be charged an additional £50 for each hour the booking goes over. The customer will still be charged the full £50 even if the time is extended by 30 minutes.

4. Copyright and Usage: VisionCapture retains the copyright and ownership of all images and videos captured during the session, including raw and edited files. The client is granted personal, non-commercial usage rights to the delivered images and videos. The client may print, share, and display the images for personal use, but not for commercial purposes.

5. Model Release: The client grants VisionCapture permission to use the images or videos captured during the session for promotional and marketing purposes, including but not limited to online portfolios, social media, advertisements, and publications. If the client wishes to keep their images or videos private and not be used for promotional purposes, a written request must be submitted to VisionCapture prior to the session.

6. Attendance and Conduct: The client is responsible for ensuring that all participants involved in the session arrive on time and are appropriately dressed and prepared. VisionCapture reserves the right to terminate the session or refuse service if any participant displays inappropriate or offensive behaviour towards the photographer or other individuals present.

7. Delivery and Editing: VisionCapture will make reasonable efforts to deliver the edited images or videos soon as possible, but does not guarantee a specific delivery date. The number of edited images delivered may vary and is at the discretion of VisionCapture. VisionCapture will apply professional editing techniques to the selected images or videos, but will not provide raw or unedited files to the client.

8. Liability: VisionCapture will take utmost care in capturing and processing the images or videos. However, in the event of unforeseen circumstances, including equipment malfunction or other technical issues, VisionCapture will not be held liable for any resulting damages, losses, or additional expenses. The client acknowledges and assumes all risks associated with participation in the photography session.

9. Governing Law and Jurisdiction: a. These terms and conditions shall be governed by and construed in accordance with the laws of Jurisdiction. Any disputes arising out of these terms and conditions shall be subject to the exclusive jurisdiction of the court.

By engaging in a photography service agreement with VisionCapture, the client acknowledges that they have read, understood, and agreed to these terms and conditions.
